HCPCS E0738 (upper-limb rehabilitation system): commercial payer coverage 2026
Which US commercial payers address an upper-limb rehabilitation system billed as HCPCS E0738, and what they say. One row per payer, with the policy number, the stated date, a short summary, a verbatim quote where there is one, and a link to the payer’s own policy.
Last checked 2026-10-15. Sources are each payer's own public document. Where a payer has no readable public policy, this page says "could not verify" rather than guess a stance.

What E0738 is
E0738 is an "upper extremity rehabilitation system providing active assistance to facilitate muscle re-education, include microprocessor, all components and accessories". E0739 is a separate code for a rehabilitation system with an interactive interface.
Several payers tie E0738 to specific devices by name. A MyoPro-type powered orthosis is billed with L8701 / L8702, not E0738, so a MyoPro policy is not an E0738 stance.
No public commercial policy covers E0738 with criteria. Every commercial policy that names the code calls it investigational, experimental, unproven or not medically necessary. Many large payers have no E0738 policy at all, which leaves an E0738 claim with no device-specific denial policy to cite.

What each payer says
The quote is the payer's own, verbatim and under 30 words, linked to the source. The classification is the payer's, not ours.
Aetna Experimental / investigational / unproven
CPB 0778, Robotic-assisted Rehabilitation of the Extremities. Last review 04/22/2026. Effective 03/20/2009..
“Aetna considers the following robotic-assisted rehabilitation interventions and devices experimental, investigational, or unproven because their effectiveness has not been established ... IpsiHand”
Aetna, aetna.com CPB 0778
E0738, E0739, L8701 and L8702 sit under "HCPCS codes not covered for indications listed in the CPB". Stroke is a listed E/I indication for robotic-assisted upper-limb rehab. A specific device has been named in the list since the 06/14/2024 revision.
Cigna Experimental / investigational / unproven
Medical Coverage Policy 0565, Prescription Digital Therapeutics. Effective 06/15/2026. New policy effective 09/15/2025..
“ALL of the following are considered experimental, investigational and unproven: ... E0738 E0739 ... IpsiHand™ (Neurolutions, Santa Cruz, CA)”
Cigna, static.cigna.com 0565 (PDF)
E0738, E0739 and the named device sit on the E/I list. The general prescription digital therapeutics criteria do not apply to items on that list. Cigna files this code under Prescription Digital Therapeutics, not DME or orthotics.
Elevance / Anthem Investigational and not medically necessary
DME.00052, Brain Computer Interface Rehabilitation Devices. Last review 08/13/2026. Published 10/01/2026..
“Brain computer interface rehabilitation devices, including but not limited to electroencephalography (EEG)-driven upper extremity powered exercisers, are considered investigational and not medically necessary.”
Elevance / Anthem, anthem.com DME.00052
Applies to all BCI rehab devices; the ICD-10 table reads "All diagnoses". The rationale is the only one found that reviews the BCI-REHAB RCT (Leuthardt 2026). It accepts an effect on upper-extremity impairment but cites attrition, no sham control, EEG-screened enrollment, no follow-up and no functional gain.
Centene / Ambetter Not medically necessary
CP.MP.107, DME and Orthotics and Prosthetics Guidelines ("Myoelectric Rehabilitation Systems" row). Date of last revision 08/26. E0738 row added in the 07/25 review..
“Myoelectric Rehabilitation Systems ... Not medically necessary, as there is insufficient evidence in published peer-reviewed literature to support the effectiveness of these devices.”
Centene / Ambetter, ambetterhealth.com CP.MP.107 (PDF)
The row covers E0738 and E0739 only. L8701/L8702 (MyoPro) were removed from the policy in the same 07/25 change. The row is labeled "Myoelectric", although at least one named device is EEG-driven.
UnitedHealthcare Not addressed by a public policy
No E0738 policy (all 251 commercial medical/drug policies searched). Omnibus Codes effective 06/01/2026 (E0738 not in any policy).
E0738, E0739 and "brain-computer" appear in none of UHC’s 251 commercial policies. The only related policy covers a MyoPro-type orthosis (L8701/L8702), which it calls unproven; it does not list E0738. Determinations would fall to the plan’s general DME and unproven-services definitions.
Humana No current commercial policy
None (Humana exited employer-group commercial medical in 2025). n/a.
Humana finished leaving the employer-group commercial medical business in 2025 (exit announced 02/23/2023). Not researched further in the snapshot.
Kaiser Permanente (Washington) Not addressed by a public policy
No E0738 criteria (Clinical Review Criteria "Device, Equipment and Supplies"). DME criteria last entry 9/25/2025 (E0738 not listed).
The DME criteria and the DME authorization-code list do not list E0738 or the related device. No criteria found.
Premera Blue Cross Not addressed by a public policy
No E0738 policy (1.04.502, Myoelectric Prosthetic/Orthotic Components for the Upper Limb). 1.04.502 effective 06/01/2026 (E0738 not listed).
Premera’s myoelectric upper-limb policy does not list E0738. It calls a MyoPro-type powered orthosis (L8701/L8702) investigational, which is a different code and device.
Blue Shield of California Not addressed by a public policy
No E0738 policy (1.04.04, Myoelectric Prosthetic/Orthotic Components for the Upper Limb). 1.04.04 effective 06/01/2026 (E0738 not listed).
The myoelectric upper-limb policy does not list E0738. It calls myoelectric-controlled upper-limb orthoses investigational, which is a different code and device.
BCBS Federal Employee Program Not addressed by a public policy
No E0738 policy (FEP 1.04.04). FEP 1.04.04 annual effective date 07/01/2026 (E0738 not listed).
FEP 1.04.04 does not list E0738. It calls myoelectric-controlled upper-limb orthoses investigational, which is a different code and device.
BCBS Kansas Not addressed by a public policy
No E0738 policy (Myoelectric Prosthetic Components for the Upper Limb). Latest review 05/26/2026 (E0738 not listed).
The myoelectric policy covers prosthetic components only and does not list E0738. No E0738 or BCI policy was found.

HCSC (BCBS TX, IL, OK, NM, MT) Could not verify (commercial copy bot-blocked)
DME101.054, Brain Computer Interface Rehabilitation Devices. Effective 07/21/2026 (HealthSpring Medicare Advantage copy).
“Brain computer interface rehabilitation devices ... (e.g., the IpsiHand® Upper Extremity Rehabilitation System) are considered experimental, investigational and/or unproven.”
HCSC HealthSpring (Medicare Advantage) copy; the commercial copy returned HTTP 403, healthspring.com DME101.054 (PDF)
E0738 is the only code listed. The quote is from the HealthSpring Medicare Advantage copy. The HCSC commercial copies (medicalpolicy.bcbstx.com) return HTTP 403, so the commercial stance is not verified.
Regence (OR/UT/WA/ID, probable) Could not verify (plan attribution not verified)
DME94, Upper Extremity Rehabilitation System with Brain-Computer Interface. Effective 05/01/2026. Last review March 2026..
“The use of an upper extremity rehabilitation system with brain-computer interface is considered investigational for any indication.”
PDF hosted on a Cambia brand server; the plan name is not printed, so attribution to Regence is not verified, Cambia-hosted DME94 (PDF)
E0738 is the only code listed. The policy PDF does not print the plan name and the plan’s own pages return HTTP 403, so the Regence attribution is not verified.
What changed recently
- Anthem DME.00052 (review 08/13/2026, published 10/01/2026): the rationale was rewritten around the BCI-REHAB RCT (Leuthardt 2026) and two 2026 meta-analyses. A member summary was added. The stance did not change (investigational and not medically necessary).
- HCSC DME101.054 is new (effective 07/21/2026) on the HealthSpring Medicare Advantage site. Cigna 0565 is new (effective 09/15/2025) and puts E0738, E0739 and a named device on an E/I list; two 2026 reviews did not change that line.
- Regence DME94 (last review March 2026, effective 05/01/2026) stays investigational for any indication. Aetna CPB 0778 has listed the device as E/I since 06/14/2024; its stated next review (09/11/2026) has passed without a posted update.
- Centene CP.MP.107: E0738/E0739 replaced the MyoPro codes in the 07/25 annual review. Medicare moved the other way: CMS Transmittal 13889 (07/30/2026) wrote the E0738 DME benefit category into the Benefit Policy Manual.
Medicare classifies E0738 as DME
Context only, not a commercial policy. Medicare and commercial point in opposite directions here. There is no NCD or LCD for E0738. CMS classifies it as DME: Transmittal 13889 (Pub. 100-02, dated 07/30/2026, effective 08/28/2026) lists E0738 with benefit category "DME", and the October 2026 DMEPOS fee schedule sets a national capped-rental payment.
- E0738-RR is payment category CR (capped rental), with a uniform national monthly allowance across all state columns.
- E0739 is listed as a separate capped-rental item.
So the same code that commercial payers call investigational carries a published Medicare DME capped-rental fee and no Medicare exclusion.
Why these deny, and how the appeal works
No patient data. No BAA. No charge.
E0738 denials are device-category denials: payers that name the code call it investigational, and payers that do not have fallen back to general DME or unproven-services rules. The appeal has to cite the exact policy the payer used and the clinical record, and it has to separate E0738 from unrelated codes such as L8701 and L8702. Send us 90 days of denials, 4 columns, and you get back which E0738 lines are worth working and what they are worth. The first review is free.
